Rural exemptions under the old regulations were removed in September 2010. Under the new model Work Health and Safety Regulation there are a number of new requirements relevant to the rural industry including remote or isolated work, chemicals and asbestos that will apply to the rural industry from 1 January 2012.

Forklift licensing in the rural industry

The current exemption that applies to high risk work (HRW) licensing for the rural industry, including forklifts, ceases on 1 January 2012 with the commencement of the Work Health and Safety Act 2011.

This means that anyone carrying out high risk work in the rural industry, such as operating a forklift, must hold a high risk work licence from 1 January 2012.

PCBU responsibilities

The model Work Health and Safety Regulation (model WHS Regulation) brings new duties for a person conducting a business or undertaking (PCBU) that include:
  • managing the risk of a musculoskeletal disorder associated with a hazardous manual task
  • ensuring effective communication with remote and isolated workers to enable access for workers to assistance
  • managing the risks of falls and falling objects.
